Biographical Information

Mr. Gold is the principal shareholder of the Pennsylvania & New Jersey employment law firm of Sidney L. Gold & Associates, P.C. in Philadelphia, which has been recognized by the Martindale-Hubbell Bar Register as a preeminent law firm in the field of employment law and civil rights litigation. His practice, as well as that of the law firm, is exclusively concentrated in the representation of both employees and employers in all aspects of employment related litigation in Pennsylvania and New Jersey, including claims under federal and state anti-discrimination laws and federal civil rights laws.

Mr. Gold is a 1975 graduate of Temple University School of Law. Before entering private practice, Mr. Gold served as an Assistant City Solicitor for the City of Philadelphia in its Major Trial Division. He has litigated complex cases before courts throughout the United States, and has been admitted to practice before the U.S. District Court for the Eastern District of Pennsylvania, the U.S. District Court for the District of New Jersey, as well as the U.S. Court of Appeals for the Second, Third and Fourth Circuits and the United States Supreme Court.

Professional Experience

As a New Jersey and Pennsylvania employment lawyer, he has extensive experience counseling employers regarding compliance with Title VII, the ADA, and the ADEA and FMLA. Mr. Gold has significant experience in representing both private sector and public sector employers, including state universities and municipalities in employment and civil rights matters. His labor law firm was lead counsel in the nationwide class action against Abercrombie & Fitch.

He has written extensively on issues of employment discrimination and has authored many articles for the Legal Intelligencer and Pennsylvania Law Weekly. Mr. Gold has also given presentations on employment law to the Philadelphia Bar Association and the Pennsylvania Bar Institute. He is well-recognized as the preeminent Pennsylvania employment lawyer and is often asked to appear on local news broadcasts to discuss the latest employment law topics of interest.

He serves as an arbitrator and mediator for the U.S. District Court for the Eastern District of Pennsylvania. He has also served as Vice Chair of the Eastern Pennsylvania Chapter of the National Employment Lawyers Association. Mr. Gold has also served as Co-Chair of the Labor and Employment Law Committee of the Philadelphia Bar Association for seven years. In addition, he is a member of the Professional Guidance Committee, the Federal Courts Committee of the Philadelphia Bar Association and the Labor and Employment Law Committee of the Pennsylvania Bar Association. Mr. Gold also serves on the Faculty and Planning Committee of the Pennsylvania Bar Institute Employment Law Institute.

Mr. Gold was selected for inclusion in Philadelphia Magazine’s Super Lawyers in the area of employment law each year since 2004. Mr. Gold was named to the Best Lawyers in America for the years, 2009, 2010, 2012, 2013, 2014, 2015 & 2016. He has earned the highest rating of preeminence in the field of employment law by the Martindale-Hubbell Bar Register. Martindale-Hubbell has additionally rated him as an “AV Rated” attorney for fifteen consecutive years – the highest possible peer review rating in Legal Ability and Ethical Standards.

$50 M Settlement in Nationwide Class Action Discrimination Suit against Abercrombie & Fitch

Philadelphia employment lawyer, Sidney L. Gold, served as one of the lead attorneys in a nationwide class action lawsuit against Abercrombie & Fitch that accused the company of maintaining a “virtually all-white” and predominantly male sales force in it’s 600+ stores. The company agreed to pay nearly $50 Million and instituted sweeping changes in its hiring practices as a result of the efforts of Sidney L. Gold & Associates.

$38 M Settlement in Purolite Case -December, 2010

Philadelphia employment lawyerSidney L. Gold, represented the plaintiff in a complex intellectual property lawsuit that involved former employees and the alleged theft of trade secrets. The case was hard-fought for 5 years before Judge Cynthia Rufe in the United States District Court for the Eastern District of Pennsylvania. The litigation included several novel legal questions and resulted in several published opinions on key issues. It settled for $38 million and an agreement between the parties to jointly own the technology and information at the center of the dispute.

$9.5 M Class-Action Settlement for Retirement Benefits – October, 2014

Philadelphia employment lawyer, Sidney L. Gold, recently obtained a $9.5 million settlement in a ten-year old class action lawsuit.  One-hundred former employees of Owens-Illinois brought the claim against their former employer.  The former workers were long-term employees with the company when the company sold, preventing them from collecting their entitled retirement benefits.

Mr. Gold, of Philadelphia’s employment law firm Sidney L. Gold & Associates, P.C., was co-counsel for the group of employees, along with the Console Law Offices LLC.  The settlement approved by a U.S. district court judge allows each former employee to receive the original retirement benefit they were eligible for, in addition to a lump sum settlement amount.

The substantial settlement is a significant accomplishment for Mr. Gold who tenaciously pursued the claim for the workers over a decade long period.

Representative Cases

Philadelphia employment lawyer, Sidney L. Gold, Principal Shareholder of Sidney L. Gold & Associates, has filed a wrongful termination lawsuit on behalf of his client who alleges racial discrimination and harassment as an employee of PL Phase One Operations LP, doing business as Xfinity Live! Philadelphia. The plaintiff, an African-American, worked as a security guard and operations manager from January 1, 2012 until May 23, 2014. During his employment, he asserts that he suffered relentless, racially-motivated verbal abuse and discrimination. According to the complaint, the employee reported the harassment and discriminatory conduct to a human resources coordinator on May 2, 2014, who failed to take action to address the problem.

Mr. Gold also filed an age discrimination and wrongful termination lawsuit on behalf of his client in the U.S. District Court for the Eastern District of Pennsylvaniaagainst Sparks Exhibits & Environment Corp. Gold’s client of Napa, California, was employed by Sparks, a Philadelphia company, as vice president of strategic accounts from January, 2014 to June, 2014. According to the complaint, over the course of her employment the plaintiff alleges she was subject to discrimination based on her age and sex. She asserts that she was denied opportunity for growth and excluded from important accounts. After enduring blatant attempts to have her employment terminated, the employee states she was fired in June. The articulated reason for her termination was based on her age and sex. A younger male has since filled the plaintiff’s position.

On February 17, 2016, Mr. Gold filed a complaint in the U.S. District Court for the Eastern District of Pennsylvania against Good Shepherd Penn Partners on behalf of his client alleging discrimination and wrongful termination. According to the lawsuit, Good Shepherd violated the Americans with Disabilities Act (ADA) and the Pennsylvania Human Relations Act (PHRA) when they fired Paula Patton after she suffered an epileptic seizure brought on by unreasonable and intolerable working conditions. Service Activities

Gold & Associates is pleased to serve as the Chair of the Philadelphia Bar Association’s Labor and Employment Law Committee for 2016. Mr. Gold has spent more than 30 years defending the rights of those who have faced discriminatory practices. Attorney Gold’s extensive experience, work ethic and dedication to representing victims of employment discrimination, retaliation and harassment make him well suited for this appointment.

This past holiday season, Mr. Gold’s firm participated in the toy drop at the Salvation Army. The Seasonal Services Program Administrator was very appreciative of our firm’s efforts. The specific children that our staff purchased toys for were nominated by ActionAIDS and local schools serving children with special needs.
